By accessing and using TheGunDock website ("Site"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site or purchase products from us.
2. Eligibility and Age Requirements
You must meet the following requirements to purchase from TheGunDock:
- Minimum Age: 21 years old for handguns and handgun ammunition; 18 years old for rifles, shotguns, and ammunition
- Legal Status: Not prohibited by federal, state, or local law from purchasing, possessing, or receiving firearms or ammunition
- Background Check: Able to pass a federal NICS background check
- Valid ID: Possess valid government-issued identification
3. FFL Transfer Requirement
All firearms must be shipped to a Federal Firearms Licensed (FFL) dealer. You are responsible for:
- Selecting a valid FFL dealer who accepts transfers
- Providing accurate FFL dealer information during checkout
- Paying any FFL transfer fees charged by the receiving dealer
- Completing all required paperwork (ATF Form 4473)
- Picking up your firearm from the FFL dealer in a timely manner
We will ship firearms only after verifying the FFL dealer's license is current and valid.
4. Legal Compliance & Customer Responsibility
By purchasing from TheGunDock, you certify that:
- State/Local Laws: You have researched and understand all applicable state and local laws regarding firearm ownership in your jurisdiction
- Legal Purchase: The items you are purchasing are legal to own in your state and locality
- You are not a convicted felon
- You are not subject to a restraining order for domestic violence
- You have not been convicted of a misdemeanor crime of domestic violence
- You are not a fugitive from justice
- You are not an unlawful user of or addicted to controlled substances
- You have not been adjudicated as mentally defective or committed to a mental institution
- You are not an illegal alien or nonimmigrant alien (with limited exceptions)
- You have not been dishonorably discharged from the Armed Forces
- You have not renounced your U.S. citizenship
Providing false information is a federal crime punishable by imprisonment and fines.
5. State and Local Restrictions
Some firearms, accessories, and ammunition may be restricted or prohibited in certain states, counties, or cities. It is your responsibility to know and comply with all applicable laws.
State-Specific Restrictions:
- California: 10-day waiting period, assault weapon restrictions, magazine capacity limits
- New York: SAFE Act restrictions, pistol permits required for handguns
- New Jersey: Firearms purchaser ID card required, strict assault weapon laws
- Massachusetts: License to carry or FID card required, assault weapon ban
- Connecticut: Permit required for handgun purchases, assault weapon restrictions
- Illinois: FOID card required for all firearms and ammunition purchases
- Hawaii: Permit to acquire required for each firearm
- Washington D.C.: Strict registration and permit requirements
We reserve the right to refuse shipment to restricted locations or cancel orders that violate applicable laws.
6. Payment Terms
All prices are in U.S. Dollars (USD). Payment terms:
- Payment Due: Full payment required at time of order
- Accepted Methods: Visa, Mastercard, American Express, Discover
- Secure Processing: All payments processed through Authorize.net with 256-bit SSL encryption
- Authorization Hold: Your card will be authorized at checkout and charged when order ships
- Tax: Sales tax applied based on shipping destination where required
7. Pricing and Availability
Product prices and availability are subject to change without notice. We reserve the right to:
- Modify prices at any time before order confirmation
- Limit quantities on certain products
- Discontinue products without notice
- Refuse or cancel orders for any reason
If a price error occurs, we will notify you before processing your order and give you the option to cancel.
8. Shipping Policy
Firearms Shipping:
- Shipped to FFL dealers only via UPS, FedEx, or USPS
- Adult signature (21+) required at FFL location
- Tracking information provided via email
- Shipping times vary based on carrier, distance, and other factors
- Carrier Selection: We reserve the right to select the most appropriate carrier for your order. If you require a specific carrier, please contact us before ordering - additional fees may apply.
Alaska, Hawaii, Puerto Rico, Guam & Other US Territories:
- NO AMMUNITION OR HAZMAT: We do not ship ammunition, primers, powders, or any hazmat items to Alaska or Hawaii under any circumstances.
- APO/FPO addresses handled on a case-by-case basis - contact us before ordering.
- We highly encourage you to contact us before purchasing if you are outside the lower 48 states.
Heavy & Oversized Items:
- Additional shipping charges may apply for heavy items (above 10 lbs) or items exceeding 48" in shipping dimensions.
- We will contact you for approval before shipping if additional fees apply.
- Request a shipping quote from us prior to ordering for bulk or oversized items to avoid unexpected costs.
Hazmat Items:
- Primers, powder, percussion caps, or any item considered "hazmat" will incur an additional $22 Carrier Hazmat fee billed at time of shipment.
Expedited Shipping:
- Overnight and 2nd-day air options may be available on most items including firearms.
- Contact us to check your options if you need faster delivery.
NFA/Class III Items (Suppressors, SBRs, etc.):
- Suppressors and SBRs require ATF Form 3 completion and approval before being transferred to your dealer.
- The Form 3 process typically takes 2-15 business days.
- Shipping for these items begins within 24 hours of receiving Form 3 approval.
- Shipping timeline is dependent on ATF approval process.
Ammunition & Accessories Shipping:
- Can ship directly to your address in most states
- Some states require proof of firearms license or ID
- Ammunition cannot be shipped via USPS (uses UPS/FedEx only)
- Adult signature may be required based on carrier and state
Address Errors & Intercepts:
- If your order cannot be canceled prior to shipping, a "Return to Sender Delivery Intercept" can be arranged for a fee (typically $15-$20 depending on carrier).
- All successful intercepts are subject to a fee per tracking number plus any transportation charges.
- If an item is Returned to Sender due to a closed business, incorrect address, or other reasons, you will be required to pay for shipping again for reshipment.
- The customer is responsible for ALL fees associated with address errors.
Fraud Verification:
- For orders with different billing and shipping addresses, we will verify the "AVS" response address associated with your credit card.
- Orders over $100 with separate billing and shipping addresses will undergo anti-fraud verification which may require customer response.
Shipping Restrictions:
- No international shipping.
- P.O. Boxes: Only certain items may be shipped to a P.O. Box. If a P.O. Box is your only option, contact us prior to purchasing.
- APO/FPO addresses: Contact us before ordering for a shipping quote (case-by-case basis).
FFL Dealer Requirements:
- It is the buyer's responsibility to arrange for transfer at their FFL dealer.
- You or your receiving dealer must send us a copy of their valid, unaltered, unredacted, current, and signed FFL license.
- Failure to provide FFL information may delay processing of your order.
- Please confirm with your dealer about their ability and willingness to receive the item before placing the order.
9. Returns, Refunds, and Cancellations
Due to the regulated nature of firearms, our return policy is strict. All returns are subject to TheGunDock's Return Conditions.
General Return Conditions:
- NEW Condition Required: Items must be returned in NEW condition (not used, broken, or worn), in the original manufacturer's packaging with all original contents included.
- 10% Restocking Fee: A 10% restocking fee applies to ALL returns unless the return is due to our error (wrong item shipped, defective product shipped, etc.).
- Return Shipping: Customer is responsible for all return shipping costs unless return is due to our error.
- Approval Required: Contact us before returning any item. Unauthorized returns may be refused.
Wrong Item Shipped (Our Error):
If you receive an item that is not as described or we shipped the wrong item:
- Return Shipping: We will pay for return shipping.
- Full Refund: You will receive a 100% refund of the purchase price, shipping costs, and any taxes collected.
- No Guarantee of Replacement: A refund does NOT mean you will receive the item you originally ordered. The correct item may no longer be available, or there may be price discrepancies if the item was listed incorrectly.
- Re-Order Option: We reserve the right and option to try to fulfill your order with the correct item, but due to inventory and pricing factors, this may not always be possible.
- Dealer Transfer Fees NOT Covered: If you accepted transfer of the wrong firearm (completed 4473 and took it home) because you failed to inspect it at the dealer, we will NOT reimburse your FFL dealer transfer fees. ALWAYS INSPECT YOUR FIREARM BEFORE ACCEPTING TRANSFER.
Firearms Returns (Before Transfer Only):
- INSPECT BEFORE ACCEPTING: Please inspect your new firearm(s) at the dealer BEFORE ACCEPTING TRANSFER.
- 7-Day Inspection Period: Once the firearm arrives at your dealer, you have SEVEN (7) calendar days to fully inspect. After sitting 7 days at your dealer, returns/exchanges will NOT BE ACCEPTED unless approved by TheGunDock.
- Before Transfer: If the wrong item was shipped, notify the FFL dealer immediately BEFORE completing the 4473. The FFL can refuse the transfer and return the firearm to us.
- Return Shipping: Must be shipped via FFL dealer to our FFL dealer
- Restocking Fee: 10% restocking fee applies to ALL returns
Optics & Electronics:
NFA/Class III Items:
- Returns are handled on a case-by-case basis due to potentially lengthy return times.
- Contact us for inquiries regarding the return of Class III items.
Warranties & Repairs:
- TheGunDock offers no warranties, expressed or implied, other than the warranties supplied by the manufacturers of the products we offer for resale.
- Defective merchandise must be returned directly to the manufacturer.
- We do not have the ability to make repairs.
Ammunition & Accessories Returns:
- Must be unopened in original packaging
- Return within 30 days of receipt
- 10% restocking fee applies (waived only if return is due to our error)
- Customer pays return shipping unless return is due to our error
Order Cancellation by Customer:
- Orders can be cancelled before shipment

- No cancellations after order has been processed and/or shipped
- No cancellations after FFL dealer receives shipment
- Special Orders: Special-order items cannot be canceled once they are processed and/or shipped.
Order Cancellation by TheGunDock:
Please note that your order may be canceled by TheGunDock for the following reasons:
- The ordered item cannot be shipped to you due to U.S. Government Regulations, Export Control Policy, or our Domestic Product Policy
- Additional information needed to process the order was not provided in a timely manner
- The item has been discontinued or is no longer available
- Out of Stock: Item is no longer available in our inventory
- Due to our Pricing Policy (pricing errors)
- Payment not received
- Failed fraud verification
We do our absolute best to ensure every item listed on our website is in stock, and we hate canceling orders just as much as you hate having them canceled. We are NOT in the business of canceling orders - we want to fill every single one. But occasionally, an item may sell on another platform before we can update inventory everywhere. In these rare cases, we will notify you immediately and issue a full refund.

10. Refused or Unclaimed Firearms
If a firearm shipment is refused or not picked up from the FFL dealer within 30 days:
- The firearm will be returned to us at YOUR expense
- You are responsible for ALL return shipping costs
- A 10% restocking fee will apply
- Original shipping costs are non-refundable
- Refund (if any) issued only after we receive the firearm, minus all shipping and restocking fees
11. Background Check Denials & Transfer Failures
If you are denied on the NICS background check or cannot complete the transfer for ANY reason:
- The firearm cannot be released to you
- The firearm will be returned to us at YOUR expense - you must pay all return shipping costs
- A 10% restocking fee will apply
- Original shipping costs are non-refundable
- Refund (if any) will be issued only after we receive the firearm back, minus all shipping and restocking fees
- Appeal process available through FBI NICS - we will hold the firearm for up to 30 days while you appeal
Bottom Line: TheGunDock is not responsible for any costs if you cannot legally purchase or possess a firearm. Know your eligibility and local laws BEFORE ordering.
12. Product Descriptions and Accuracy
We strive for accuracy in all product descriptions, specifications, and images. However:
- Manufacturer specifications may change without notice
- Images may show accessories not included with product
- Colors may vary slightly from images
- We are not responsible for typographical errors
13. Intellectual Property
All content on this Site, including text, graphics, logos, images, and software, is the property of TheGunDock or its content suppliers and is protected by U.S. and international copyright laws.
14. Limitation of Liability
TheGunDock is not liable for:
- Misuse, abuse, or negligent handling of products purchased
- Injuries or damages resulting from product use
- Indirect, incidental, or consequential damages
- Delays caused by carriers, FFL dealers, or background check systems
- Changes in federal, state, or local laws affecting your purchase
Maximum Liability: Our total liability shall not exceed the purchase price of the product.

You agree to indemnify and hold harmless TheGunDock, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of products purchased from us

19. Dispute Resolution
Any disputes arising from these Terms and Conditions or your use of the Site shall be resolved through:

- Binding arbitration if negotiation fails
- Jurisdiction in state or federal courts in Kentucky
